Police Recognized Fall River Man Charged in North End Sexual Assault

A Fall River man was arraigned on Monday in Boston Municipal Court after being arrested on sexual assault charges for the weekend incident in the North End. Suffolk District Attorney Daniel Conley’s office said that 36-year old Wagner Nieto is being held on $10,000 bail.

According to the victim, she was walking home around 3 am on Saturday when she noticed an unknown man walking behind her in the area of Tileston and Wiggin Streets. A brief conversation ensued when she turned to acknowledge him. The man assaulted her and she struck him, at which point the man fled on foot.

Using surveillance tapes from the area, Boston Police District A-1 officers recognized the man from an earlier incident that night when he appeared intoxicated. Through information in a Field Interview and Observation report, detectives located the suspect at his home in Fall River later on Saturday night.

Nieto does not appear to match the description of the suspect in another sexual assault in the North End earlier this year, according to a release by the DA’s office.

The next court date is set for November 13, 2014.

All defendants are presumed innocent until proven guilty in a court of law.
